1. Introduction

    Allina Health d/b/a wellclicks® ("us," "we" or "our") is committed to respecting the privacy rights of our clients, visitors and other users of our Internet-based portal, Family Health Manager, which we make available through provider websites ("Family Health Manager"). This Privacy and Security Policy ("Privacy Policy") serves to help you understand the measures we are taking to protect your privacy and personal information while navigating the Family Health Manager. This Privacy Policy is only applicable to Family Health Manager, and not to any other websites that you may be able to access from Family Health Manager, including the websites of your provider or websites that you have visited that allowed you access to Family Health Manager. We are not responsible for the content and practices of any websites outside of Family Health Manager, which includes provider, insurance, health information, partners and any other websites.

  2. Log Files and Traffic Data

    Any time you visit Family Health Manager, our servers automatically track and collect information from your web browser. This information includes (1) your IP address, (2) browser type, (3) referring/exit pages, (4) operating system type and version, (5) a date/time stamp, (6) estimated geographic location, and (7) other information associated with the interaction of your browser and Family Health Manager (collectively "Traffic Data"). This information is stored in temporary log files ("Log Files") that reside on our web servers for no more than one week. After one week, our Log Files are removed and archived. We use archived Log Files to help us analyze trends, administer Family Health Manager, prevent fraud, prevent and respond to other security concerns, track visitor movement in aggregate, and gather broad demographic information. The Log Files will be shared with the provider whose website you use to access Family Health Manager.

  3. Personally Identifiable Information

    In order for you to access certain areas of Family Health Manager, we may require you to provide us with information that personally identifies you, also known as personally identifiable information ("Personal Information"). For purposes of this Privacy Policy, "Personal Information" includes the following categories of information: (1) contact data (such as your email address, phone number and physical address); (2) demographic data (such as your gender, your date of birth and your ZIP code used for calculating a geographic location); (3) insurance data (such as your insurance carrier and insurance plan); (4) personal preference data (such as search filters used during the matching process); (5) health and medical data (such as information you supply in response to health assessments, information about health and wellness providers you have visited and other information about those visits, and other health and medical information you choose to save); (6) registration data (such as your first name, last name, password and other information requested by providers); and (7) credit card numbers and expiration dates if used so that you can register for events or other activities through Family Health Manager (each a "Credit Card Transaction").

  4. Confidentiality of Information

    Except as otherwise provided in this Privacy Policy, we will keep your Personal Information confidential and will not share it with others unless we believe that disclosure of your Personal Information or other information we collect about you is necessary to: (1) comply with law, a court order, or other legal requirement; (2) protect the rights, property or safety of us or others; (3) enforce our Terms of Use; or (4) respond to claims that any posting or other content violates the rights of others. We only collect and use information obtained from Credit Card Transactions for business purposes, such as registrations for our events.

    If you have accessed the Family Health Manager through your provider's website, your provider may access, use or share your Personal Information for purposes of providing medical care and treatment to you or for its health care operations. Your provider is responsible for obtaining consent from you that it may require to access, use or share your Personal Information for these purposes. Refer to your provider's notice of privacy practices for more information regarding your provider's handling of your Personal Information.

  5. Providers

    We grant software licenses to providers, which enable these providers to provide you access to Family Health Manager through the provider's website. All providers have entered into a license and services agreement (the "Client Agreement") with us. Only providers who have agreed to the terms of the Client Agreement (each a "Provider") can facilitate your access to Family Health Manager through the provider's website. The provider website you used to access Family Health Manager has developed customized Family Health Manager content to facilitate your experience on Family Health Manager.

  6. Profiles

    Family Health Manager features profiles that aid in the process of matching you with particular providers or services based on your needs and preferences, including but not limited to: (1) providers, (2) locations, (3) brands and (4) events. Family Health Manager also features articles and series pages. The information contained within these profiles and pages (such as photographs, logos, other multimedia, descriptive text, credentials, accessibility information, basic demographics and contact information), although stored on our servers and displayed on Family Health Manager, is uploaded to Family Health Manager, and owned and managed by Providers. Providers are solely responsible for this information as more fully set forth in the Client Agreement. We reserve the right to remove any profile information from Family Health Manager at any time.

  7. Appointments

    In the future, Family Health Manager may offer interactive tools to help visitors contact and schedule appointments with Providers. During the appointment scheduling process, once implemented, we will collect and store Personal Information from visitors and use this information for the following purposes: (1) registering the visitor as a user of Family Health Manager, and (2) registering the visitor for an appointment with the requested Provider. Information collected in both categories will be stored and secured on our web servers. Information collected in "(1)" will be required to uniquely identify the user for all appointments scheduled on Family Health Manager and includes a first name, last name, date of birth, email address (user ID) and password. Information collected in "(2)" (all other information not defined in "(1)" will vary among services and appointments. This information will be uniquely configured by the Provider. All information that may be collected during the appointment scheduling and registration process will be shared with Providers with the exception of your password.

  8. Emails

    We may use your contact data to send you information via email about us, Family Health Manager or our other products or services; to contact you when necessary, including to make recommendations; and to provide reminders from Family Health Manager. You may wish to add familyhealthmanager@wellclicks.com and support@wellclicks.com to your list of accepted senders in your email account to prevent the blocking of messages from Family Health Manager. To protect your personal privacy, you may only access detailed information about your account by visiting Family Health Manager and logging in securely.

  9. Cookies

    We use "cookies" to keep track of some types of information while you are visiting Family Health Manager or using services available on Family Health Manager. Cookies are very small text-based files placed on your computer. They help us distinguish between repeat and new visitors, and identify repeat visitors when they return to Family Health Manager. They also allow us to save user preferences and track user trends in conjunction with traffic data. We rely on cookies for the proper operation of Family Health Manager; therefore, if your browser is set to reject all cookies, Family Health Manager will not function properly. Users who refuse cookies assume all responsibility for any resulting loss of functionality. We do not link the cookies to any Personal Information, and we do not use cookies to store login information such as passwords and session information.

  10. Storage, Modification and Removal of Personal Information

    All data or information collected by Family Health Manager is stored indefinitely either on or off of our web servers. We store Personal Information until you request that we modify or delete your Personal Information or your Provider no longer has a Client Agreement with us. In that case, your Provider will retain, and be responsible for, your Personal Information. In other cases, we may retain de-identified Personal Information even after a request to modify or delete Personal Information from our servers/databases or when your Provider no longer has a Client Agreement with us. Upon your request, we will use commercially reasonable efforts to modify or delete your account and de-identify the Personal Information in your profile; however, it may be impossible to remove your account without some residual de-identified Personal Information being retained by us. This residual Personal Information may be required to operate Family Health Manager. Any specific concerns about the storage of Personal Information should be directed to privacy@wellclicks.com. As to information collected from Credit Card Transactions, our employees will access this information only when there is an appropriate business reason to do so. We do use PayPal to conduct all Credit Card Transactions, so we share certain pieces of your Personal Information with PayPal in order to effectuate those transactions (including your credit card information).   11. Children

    The Family Health Manager does not direct content to persons under the age of 18, nor do we permit registration of or collect personal information about persons younger than 18.

  12. Sharing of Information

    We have the right to view and use your Personal Information for purposes of maintaining the Family Health Manager's functionality, improving the Family Health Manager's software and associated documentation (using information only in aggregate, non-personally-identifiable form), and to remove your Personal Information from the Family Health Manager upon your request. Third parties from whom we license certain features of Family Health Manager also have the right to view and use your Personal Information, but only as to those features. Their rights are no broader than ours as described in this Section 12. We share certain categories of information we collect from you in the ways described in this Privacy Policy. We may share demographic data with advertisers and other third parties only on an aggregate (i.e., non-personally-identifiable) basis. We also share Personal Information and traffic data with our business partners who assist us by performing core services (such as hosting, billing, fulfillment, or data storage and security) related to our operation of Family Health Manager and/or by making all of Family Health Manager's features available to our visitors and users. They may only use your Personal Information to carry out their specific business obligations to us and to provide your requested health and wellness services. Last, we may transfer your Personal Information to another company in connection with a merger, sale or acquisition by or of us. In this event, we will use reasonable efforts to notify you before your Personal Information is transferred and becomes subject to a different privacy policy. We do not share, sell, rent or trade your Personal Information with any third parties for their promotional purposes.

  13. User Choice

    You may choose not to provide us with any Personal Information. In such an event, you can still access and use much of Family Health Manager; however, you will not be able to access and use those portions of Family Health Manager that require your Personal Information.

  14. Public Information

    Any information that you may reveal in a customer review posting or other online discussion (i.e., messages boards or forums) is intentionally open to the public and is not private. What you have written may be seen and/or collected by third parties and may be used by others in ways we are unable to control or predict.

  15. Use for Research

    By using Family Health Manager, you agree to allow us to anonymously use the information from you and your experiences to aid our research into health and wellness matchmaking. We may publish this information publicly to share our successes in matching users with health and wellness resources. No Personal Information will be shared or made available in any published research.

  16. Security Measures and Precautions

    The security of your Personal Information is important to us. We have extensive security measures in place to protect the loss, misuse and alteration of the information stored in our databases. When you enter sensitive information on Family Health Manager (including information in connection with Credit Card Transactions), we encrypt that information using secure sockets layer technology (SSL). Certain Personal Information stored on our databases is encrypted adding an extra layer of security. We have also employed proprietary security measures for uniquely identifying users and user sessions. We will exercise reasonable care in providing secure transmission of information between your computer and our servers, but given that no information transmitted over the Internet can be guaranteed 100% secure, we cannot ensure or warrant the security of any information transmitted to us over the Internet and accept no liability for any unintentional disclosure.

  17. Lost or Stolen Information

    If we become aware that your Personal Information has been disclosed in a manner not in accordance with this Privacy Policy, we will use reasonable efforts to notify you of the nature and extent of the disclosure (to the extent we know that information) as soon as reasonably possible and as required or permitted by law. In the unlikely event that the Personal Information you have uploaded to our website has been compromised or modified without your authorization, you must promptly notify us at privacy@wellclicks.com and we will update our records and your account accordingly.

  18. Links to Other Sites

    We are not responsible for the privacy practices or the content of other websites that may be linked to and from Family Health Manager.

  19. Acceptance of Privacy Policy

    Your use of Family Health Manager, including any dispute concerning privacy, is subject to this Privacy Policy and the applicable Terms of Use. BY USING FAMILY HEALTH MANAGER, YOU ARE ACCEPTING THE PRACTICES SET OUT IN THIS PRIVACY POLICY AND THE APPLICABLE TERMS OF USE. If we decide to change our Privacy Policy, we will post those changes to this Privacy Policy page and any other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We reserve the right to modify this Privacy Policy at any time, so please review it frequently. If we make material changes to this policy, we will notify you here, or by other means, such as email, at our discretion. Your continued use of any portion of Family Health Manager or our website following posting of the updated Privacy Policy will constitute your acceptance of the changes.
